<h3 class="wp-block-heading" id="h-what-is-mediation-and-how-does-it-work">What <em>is</em> mediation – and how does it work?</h3>



<p>Mediation is a way for separated couples to resolve legal disputes (think finances, child arrangements, or both) without heading straight to court. A trained mediator acts as a neutral third party to help both people have structured, respectful conversations and reach a fair agreement.</p>



<p>Sessions are usually held in person or online, with both parties and the mediator present. In more sensitive cases, “shuttle mediation” allows each person to be in a separate room (or Zoom breakout) while the mediator moves between them.</p>



<p>Bonus? It’s usually faster, friendlier, and way cheaper than traditional legal routes.</p>



<h3 class="wp-block-heading" id="h-do-you-have-to-do-mediation">Do you <em>have</em> to do mediation?</h3>



<p>Yes – in most cases. Mediation is a legal requirement before applying to court for financial or child arrangements (unless exemptions apply). It’s what’s known as an “alternative dispute resolution” method and the court wants to know you’ve given it a proper go first.</p>



<h3 class="wp-block-heading" id="h-how-long-does-it-take">How long does it take?</h3>



<p>There’s no one-size-fits-all answer, but&nbsp;<strong>three sessions</strong>&nbsp;is fairly typical. Timings can vary depending on the complexity of your case and whether further financial info, valuations, or emotional breathing space are needed in between sessions.</p>

<h3 class="wp-block-heading" id="h-is-everyone-always-in-the-same-room">Is everyone always in the same room?</h3>



<p>Not always. Some mediations work best face to face, but when emotions are running high,&nbsp;<strong>shuttle mediation</strong>&nbsp;can be a great option. You’ll stay separate (physically or virtually), while the mediator relays messages between you – calmly and constructively.</p>



<h3 class="wp-block-heading" id="h-what-if-things-get-emotional">What if things get emotional?</h3>



<p>Spoiler: they will. But that’s totally normal. Laura and her team are trained to spot when things are veering off track – and will pause, regroup or shift the tone as needed.</p>



<p>Respect is a golden rule, and clear boundaries are set from the start. One powerful technique? Bringing the focus back to the children and asking whether this conversation is really serving&nbsp;<em>them</em>. Often, that reframing is enough to reset the room.</p>



<h3 class="wp-block-heading" id="h-how-does-mediation-help-the-kids">How does mediation help the kids?</h3>



<p>Mediation isn’t just kinder on parents – it’s better for the whole family. Avoiding a courtroom battle preserves relationships, minimises stress, and helps build a co-parenting plan that works in the&nbsp;<em>real</em>&nbsp;world. There’s also an option called&nbsp;<strong>child-inclusive mediation</strong>, where trained mediators speak with children (privately and age-appropriately) to feed in their views – without asking them to make decisions.</p>

<h3 class="wp-block-heading" id="h-does-it-actually-work">Does it <em>actually</em> work?</h3>



<p>Yes – and the stats back it up. Around&nbsp;<strong>70–80% of mediation cases</strong>&nbsp;are fully or partly resolved without going to court. If there are still sticking points, couples can opt for&nbsp;<strong>arbitration</strong>&nbsp;– a faster, more flexible alternative to court with a legally binding outcome.</p>



<h3 class="wp-block-heading" id="h-what-s-the-cost">What’s the cost?</h3>



<p>Costs vary, but for most straightforward cases,&nbsp;<strong>mediation costs each person around £1,000 – £2,000</strong>. That might sound like a lot – until you compare it with the £10k+ court route (and that’s before factoring in time, stress and sleepless nights).</p>



<h3 class="wp-block-heading" id="h-do-i-need-a-lawyer-too">Do I need a lawyer too?</h3>



<p>In short: yes. Mediators are neutral – they&nbsp;<em>can’t</em>&nbsp;give legal advice – so it’s best to get your own independent guidance alongside the process, particularly when it comes to finalising the agreement legally.</p>



<h3 class="wp-block-heading" id="h-what-happens-after-mediation">What happens after mediation?</h3>



<p>Once an agreement is reached, your mediator will draft a&nbsp;<strong>Memorandum of Understanding</strong>&nbsp;– a summary of what’s been decided. It’s not legally binding on its own, but you can take it to a solicitor to formalise it via a&nbsp;<strong>Financial Order</strong>&nbsp;or&nbsp;<strong>Parenting Plan</strong>, depending on the issue.</p>

<h3 class="wp-block-heading" id="h-how-do-i-know-i-m-ready-to-start">How do I know I’m ready to start?</h3>



<p>Emotionally, you need to be in the right place. If it’s all still raw and raw-nerve emotional, you may want to wait. Laura recommends therapy, counselling or a divorce coach to support you during the process – it helps to go in calm, clear-headed and prepared.</p>



<h3 class="wp-block-heading" id="h-most-common-questions-people-ask">Most common questions people ask</h3>



<p>Some we’ve already covered, but I get a lot of questions around confidentiality – especially if they’re already in court proceedings. It’s important they understand whatever we discuss or is agreed, they can’t repeat back to the court unless both parties consent to that. What they often want to know is can they speak to their lawyer about what they discuss which they absolutely can do.</p>



<p>Another common question is if a lawyer is necessary if they’re coming to mediation. The answer is that it depends on the issues, but we always recommend they get independent legal advice because the mediator can’t give it. It’s helpful during the process of mediation in case any legal advice is given and can be factored into the discussions along the way.&nbsp;</p>
